Section 300
Proc. 315

Subject:

Court Leave

Effective:

07/01/78

Revision (4):

06/03/08

Pay for each day of court leave shall be made at the employee's current rate of pay for a regularly scheduled work day not to exceed eight (8) hours. However, if an employee is not required to appear in court, either as a witness or for jury duty for the entire day, the employee must return to his/her normal work station at the University to be eligible to receive a full day's pay. Annual leave may be taken in lieu of court leave.

Court leave is documented on the employee’s timesheet.  If court leave is taken, a copy of the summons, subpoena, or notice to appear in court or on jury duty shall be submitted to the supervisor. If the jury service results in any personal compensation from the court, the employee is required to reimburse the University for this Compensation.  Any reimbursements from the court received by the employee for personal expenses, such as parking, mileage, and food allowances, and any non-reimbursed parking expenses shall not be included in the amount paid to the university. As soon as payment is received from the court, the employee shall submit to Human Resources the court appearance form received from the Court Clerk, complete and sign a Jury Duty Payment Record form, obtain the department head's signature, and submit both forms to the Business Office along with cash or check made out to the University of Tennessee Space Institute for the amount received. A copy of the receipt received from the Business Office, the Jury Duty Payment Record, and a copy of the court appearance form is returned to the Human Resources Office for placement in the employee’s personnel file.
